Sooma Medical – Terms of Use

Please read these Terms of Use carefully before using any part of the Sooma system or associated services. These terms include provisions that limit your rights in legal disputes, including a binding arbitration clause. Your use of the Service constitutes your acceptance of these Terms. Sooma will not be liable for any loss or damage arising from your failure to comply with these Terms of Use.
1. Introduction
Sooma Oy (“Sooma Medical”, “we”, “our”, or “us”) offers a non-invasive medical device that delivers transcranial electrical stimulation (tES) for the treatment of certain clinical conditions (the “Sooma System”). This includes a stimulation device (the “Sooma tDCS Device”), accessories and may include software applications, digital content, user support, and access to associated platforms and websites (collectively referred to as the “Service”).
Information given in advertising material is only given as guidance and shall not be binding upon the Seller.
By accessing or using the Service, you confirm that you accept and agree to be bound by these Terms of Use, along with our Privacy Policy. If you do not agree with any part of these Terms, you are not authorized to use the Service.
2. Eligibility and User Obligations
To use the Sooma Service, you must:
* Be at least 18 years of age,
* Reside in a region where Sooma Medical distributes or supports its products,
* Have legal capacity to give informed consent,
* Be under the care of a licensed healthcare professional if so indicated.
By using the Service, you confirm that you meet all eligibility criteria and that any information you provide is truthful and complete.
3. Purpose and use of the service
The Sooma tDCS device is designed for therapeutic use with professional consultation and is not a substitute for professional medical advice. Do not alter your treatment protocol without explicit clinical direction. Always adhere strictly to the User Manual and your healthcare professional’s instructions, including when they do not recommend use of the device.
Do not use the Sooma System if:
- Devices or metal objects on or inside the skull
- Acute eczema or broken skin in the stimulation area
If you encounter worsening symptoms or a medical emergency, stop use and consult a medical professional or seek emergency medical care.
4. Acceptable use policy
You agree not to:
* Use the Service for unlawful, unauthorized, or harmful purposes;
* Modify, damage, tamper with, reverse engineer, or attempt to gain unauthorized access to any part of the device or software;
* Reproduce, distribute, resell, or commercially exploit the Service or any information contained within without written permission.
* Use the system in any way contrary to official instructions for use
Sooma Medical reserves the right to suspend or terminate your access if your use violates these terms.
5. Payments
Payment processing is managed via Stripe, Inc., subject to their terms (Stripe Terms). Payments are non-refundable.
Sooma Medical reserves the right to suspend services for payment failures and may engage third parties for payment recovery. Interest on delayed payments is to be paid according to the provisions of the Finnish Interest Act. Ownership transfers upon receipt of full payment.
6. Returns
Scope. This Returns section applies only to purchases made directly from Sooma via the official webshop at soomamedical.com (“Webshop”). If you obtained your product from a sales representative, clinic, distributor, or another retailer, please contact that point of sale for their return terms.
Your statutory consumer rights remain unaffected.
1. Eligibility
You may return your kit for any reason within 30 days of delivery for a full refund.
2. How to request a return
Within 30 days of delivery, email returns@soomamedical.com and include:
- Your Payment ID (shown at the top of your purchase confirmation email)
- The email address used for the order
- Your reason for return.
3. Return shipping
Once your request is approved, we will issue a digital return label. Return shipping is free for Webshop purchases.
4. Condition of returned items
Products must be returned complete (including all accessories) and undamaged, using the provided label and suitable packaging.
5. Receipt and inspection
Upon receipt, we will conduct an inspection of the returned item to confirm condition and completeness.
6. Refunds
If the return is approved, we will issue a refund to the original payment method no later than 60 days after receipt of the returned item.
7. App access
Following completion of the refund, app access linked to the returned device will be disabled.
7. Data security
Some parts of the Service may require registration or user authentication. You are responsible for safeguarding your login credentials and all activity associated with your account. Notify Sooma immediately if you suspect unauthorized access or a security breach.
8. Privacy and Data Handling
Personal data collected through your use of the Service, including technical data, treatment logs, and feedback, will be handled in compliance with applicable regulations and our Privacy Policy. You are responsible for the accuracy, quality, legality and appropriateness of your data.
9. Intellectual Property Rights
All Sooma System intellectual property remains the exclusive property of Sooma Medical or its licensors. You are expressly restricted from publishing, selling, or otherwise commercializing any Sooma intellectual property. Please contact us should you wish to use any Sooma material. No rights are transferred without explicit written agreement.
10. Warranty
Sooma Medical warrants products against manufacturing defects for 24 months from delivery. The warranty excludes damages due to misuse, accidents, or negligence. Liability is limited to repair or replacement and excludes loss of data.
Report claims within 14 days of defect detection.
11. Limitations
Sooma Medical makes reasonable efforts to maintain accurate and secure services, but we do not guarantee uninterrupted availability or error-free operation. Except where prohibited by law, we disclaim all warranties related to the Service.
In no event shall Sooma Medical be liable for indirect, incidental, or consequential damages, including any loss of data or health outcomes resulting from improper or unauthorized use of the system.
12. Changes to terms
We may update these Terms from time to time. Updates will be posted with a revised effective date. Your continued use of the Service following such changes constitutes your acceptance of the revised Terms.
13. Termination of use
We reserve the right to suspend or permanently disable access to the Service, without prior notice, if we believe that a user has violated these Terms, applicable laws, or poses a risk to the integrity of the system or its users.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of Finland, without regard to its conflict of law principles. Any legal disputes shall be resolved under the exclusive jurisdiction of the courts of Helsinki, unless resolved through arbitration as provided below. These Terms do not limit your statutory consumer rights under applicable EU law.
15. Dispute Resolution and Arbitration
All disputes arising out of or relating to these Terms or the use of the Service shall be resolved through binding arbitration, in accordance with the rules of the Central Chamber of Commerce of Finland. By agreeing to arbitration, you waive your right to file claims in court or participate in class actions or other collective proceedings, unless such waivers are prohibited by law.
